BoomCloud challenges Apple spatial audio at ITC
Apple, Samsung, and Google face a US International Trade Commission (ITC) court challenge from spatial audio company, BoomCloud 360, reports PatentLawyer.
If successful, the case could see damages or even cease-&-desist orders on US imports in consequence.
The company is fighting for cease and desist orders on electronic devices that use certain audio technologies it claims to own.
The allegations claim that smartphones, tablets, and audio accessories infringe patents relating to spatial-audio processing and audio enhancement technology. Apple filed against these clams early August, but BoomCloud responded with a patent infringement action.
The move to act in the ITC is a new front in this legal battle. It extends the challenge as rather than simply seeking damages, it now requests a cease-and-desist order on sale of offending products. This could impact iPhone sales, theoretically.
The ITC is seeking public comment on the case. It has not begun an investigation.
